Phoenix Web Design does not warrant the functions of the Internet or that the operation of the Internet will be interrupted or error free. In no event will PWD be liable to the client or any third party for any damages, including lost profits, lost savings or other incidental, consequential damages arising out of the operation of or inability to operate the web pages or web site.
In the event that any web work performed by PWD including the home page, is found to be defective due to a fault of PWD, PWD’s liability shall be limited to the refund of fees the client paid to PDW.
Our clients warrants and represents that they have full right, power and authority to use information or material that has been provided to PWD including, without limitation, text and visual images. Because such information and materials will be transmitted, published and displayed to third parties, our clients must agree to defend, indemnify and hold PWD harmless against such claims, suits, costs, damages, judgments solicitor fees, settlements or expenses incurred, claimed, obtained or sustained by third parties, whatever the cause of action including, without limitation, defamation, misappropriation, invasion of privacy, intellectual property infringements, or otherwise, whether such claims are meritorious or not, with regard to sites undertaken by PWD on behalf of our clients
Copyright to the assembled work produced by PWD is owned by PWD. Upon final receipt of fees due, all rights owned by PWD as to the design, graphics and text in the site are assigned to the client. Rights to photographs, graphics, JavaScript and CGI programmes that were / are not owned by PWD are limited to the client’s use only; the products themselves remain the property of their respective owners
PWD may, from time to time, be asked to suggest goods, services or providers. Any mention of these within PWD web pages or during consultation is for information only; it does not imply recommendation or endorsement by PWD
PWD always purchase the domain name and hosting package on behalf of the client and in the client’s own name
